Terms & Conditions

These Terms & Conditions ("Terms") govern your use of octastdio.com (the "Site") and the marketing services provided by OctaStudio ("OctaStudio," "we," "us," or "our"). By using the Site or purchasing our Services, you ("you," "Client") agree to these Terms.

1. The Services

OctaStudio provides a done-for-you marketing retainer ("Crew Engine") for fence and tree service businesses, which may include:

A marketing website (approximately 10–20 pages)
Missed-call text-back
Automated lead follow-up
A 5-star review system
One-click marketing campaigns
On-site SEO

The exact scope is what is described on the Site and agreed at onboarding.

2. Pricing and billing

Pricing for the Crew Engine is provided to you before purchase and confirmed at onboarding.
Fees are billed on a recurring monthly basis, in advance, at the rate agreed with you.
You may cancel at any time. Cancellation stops future billing; it does not refund the current period except under the guarantee in Section 4.
Prices may change with notice; changes do not affect the current paid period.

3. Timeline

We aim to have your full marketing system built and running within 14 days of kickoff. Kickoff begins once you have submitted the required onboarding information and any access we need. Delays caused by missing information from you extend this timeline accordingly.

4. 30-day money-back guarantee

If you are not satisfied for any reason within the first 30 days of your initial paid month, you may request a full refund of that month's payment, in full, by emailing info@octastdio.com. This guarantee applies once, to your first month.

5. No guarantee of leads or results

OctaStudio builds, launches, and operates your marketing systems. We do not guarantee any specific number of leads, calls, customers, revenue, or search rankings. Marketing outcomes depend on factors outside our control, including your market, pricing, responsiveness, and demand. What we guarantee is that your marketing system is built, running, and maintained as described.

6. Your responsibilities

You agree to:

Provide accurate business information and complete the onboarding form promptly.
Grant any access we reasonably need to build and run your systems.
Ensure your business complies with applicable laws in how you serve customers.
Not use the Services for any unlawful, misleading, or harmful purpose.

You are responsible for the accuracy of the business information you provide and for your own business operations and legal compliance.

7. Intellectual property

The Site, our processes, templates, and systems remain the property of OctaStudio.
Content you provide (your logo, photos, business details) remains yours; you grant us a license to use it to deliver the Services.
The marketing website and assets we build for you are made available to you for use while you are an active, paid Client. Ownership and transfer of specific assets on cancellation, if any, are as agreed at onboarding.

8. Third-party tools

The Services run on third-party platforms (for example, GoHighLevel and hosting providers). We are not responsible for outages, changes, or failures of third-party tools, but we will work in good faith to keep your systems running.

9. Limitation of liability

To the maximum extent permitted by law, OctaStudio is not liable for any indirect, incidental, or consequential damages, or for lost profits or lost business. Our total liability for any claim is limited to the amount you paid us in the one (1) month before the claim arose. The Services are provided "as is" without warranties beyond those expressly stated here.

10. Termination

You may cancel at any time (Section 2).
We may suspend or terminate the Services if you breach these Terms, misuse the Services, or fail to pay. We may also decline to work with any business at our discretion.
Sections that by their nature should survive termination (including Sections 5, 7, 9, and 11) survive.

11. Governing law

These Terms are governed by the laws of the State of Wyoming, USA [confirm on LLC formation], without regard to conflict-of-law rules. Disputes will be resolved in the courts located in that jurisdiction.

12. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted here, with an updated "Last updated" date. Continued use of the Services means you accept the updated Terms.
